Chatham Board of Commissioners meeting agenda - 7/18/11

Pittsboro, NC - The Chatham County Board of Commissioners will meet on Monday, July 18 at the Agricultural Building audirorium in Pittsboro, NC at 6 p.m. A work session will take place earlier in the day starting at 2 pm.

INVOCATION and PLEDGE OF ALLEGIANCE

CALL TO ORDER

APPROVAL OF AGENDA and CONSENT AGENDA

The Board of Commissioners uses a Consent Agenda to act on non-controversial and routine items quickly. The Consent Agenda is acted upon by one motion and vote of the Board. Items may be removed from the Consent Agenda and placed on the Regular Agenda at the request of a Board member or citizen. The Consent Agenda contains the following items:

1. Minutes: Approval of Board Minutes for the Regular Meetings held June 6, 2011 and June 20, 2011, Work Session held June 20, 2011, and Budget Meeting held June 01, 2011

2. Fiscal Year 2010- 2011 Budget Amendments: Approval of the fiscal year 2010-2011 budget amendments as proposed by staff ( Transfers from Contingency)

3. Tax Releases and Refunds: Approval of tax releases and refunds

4. Funds Acceptance for Health Department: Approval of a request to accept funds in the amount of $43,916.00 to the Children’s Trust Fund for the Chatham County Public Health Department

5. Funds Acceptance for Health Department: Approval of a request to accept funds in the amount of $66,478.00 for a twelve-month period. The allocation is for the Children’s Resource Van. The initial four-month contract amount is $21,938.00.

6. Funds Acceptance for Health Department: Approval of a request to accept grant funds in the amount of $42,733.00 for a twelve-month allocation period for the Focus on Father’s Program and the initial four-month contract amount of $14,102.00.

7. 2010 Community Development Block Grant Scattered Site Housing and 2010 Community Development Grant Economic Recovery Programs:

Approval of compliance documents for submittal to the NC Department of Commerce, Community Investment & Assistance for the 2010 Community Development Block Grant Scattered Site Housing and 2010 Community Development Block Grant Economic Recovery Programs ( Link)

8. Final Plat Approval of “Briar Chapel, Phase 5 North: Approval of a request by Bill Mumford, Assistant Vice President on behalf of NNP Briar Chapel, LLC for final plat approval of “Briar Chapel, Phase 5 North”, consisting of 174 lots on 45.92 acres, located off Andrews Store Road/Parker Herndon Road, Baldwin Township ( Link)

9. Joint-Use Library Inter-Institutional Agreement: Approval of the Maintenance and Operations Supplement to the Joint-Use Library Inter-institutional Agreement ( Supplement)

10. Non-Profit Contract: Approval of the Contract between Chatham County and Chatham Trades, Inc. ( Contract)

11. Law Enforcement Parking Lot Improvements Bid: Approval of request to award the bid for the Law Enforcement Parking Lot Improvements in the amount of $366,077.00 to Raleigh Paving and authorize the County Manager to sign the contract on behalf of the County ( Official Bid Tabulation)

12. Designation of Voting Delegate to NCACC Annual Conference: Approval of Commissioner Mike Cross as the Designated Voting Delegate to NCACC Annual Conference.

13. Foreign Trade Zone #93: Approval of a letter of support from the County for inclusion in the expanded service area of FTZ #93 ( Fact Sheet; Brochure; Map; Sample Letter)

14. Appointments to the Board of Health: Approval of a request to reappoint members to the Chatham County Board of Health:

Rachel Stephens, full Board reappointment

Bill Browder, full Board reappointment

Mary Jackson, full Board reappointment

Gregory King, reappointment by Statute (Engineer)

Joanna Tysor, reappointment by Statute (Veterinarian)

15. Resolution Encouraging the Citizens to Observe Firefighters Week in Chatham County, NC: Approval of Resolution Encouraging the Citizens to Observe Firefighters Week in Chatham County, North Carolina during the week of September 11th in North Carolina

16. Housing Authority Appointments: Approval of Housing Authority Appointments, Vicky Oldham and Paige Otos

17. Triangle South Workforce Development Board: Approval of Theresa Isley to the Triangle South Workforce Development Board for a two-year terms ( Application)

18. Public Input Session is held to give citizens an opportunity to speak on any item, which does not appear on the day’s Agenda. The session is no more than thirty minutes long to allow as many as possible to speak. Speakers are limited to no more than three minutes each and may not concede their time to another speaker. Speakers are required to sign up in advance. Individuals who wish to speak but cannot because of time constraints will be carried to the next meeting and given priority. We apologize for the tight time restrictions. They are necessary to ensure that we complete our business. If you have insufficient time to finish your presentation, we welcome your comments in writing.

Legislative Public Hearings:

19. Public Hearing for Text Amendment to Chatham County Zoning Ordinance:

Public hearing to receive public comments on a request by the Chatham County Board of Commissioners for a text amendment to the Chatham County Zoning Ordinance to remove the Environmental Review Board from the review process for conditional use permits. ( Link)

20. Public Hearing for Text Amendments to the Subdivision Regulations:

Public hearing to receive public comments on a request by the Chatham County Board of Commissioners for text amendments to the Subdivision Regulations to modify the subdivision process and standards ( Link)

Evidentiary Public Hearings:

21. Public Hearing for Revision to Existing Conditional Use Permit: Public hearing to receive public comments on a request by Kent Dickens, dba Dickens Campground, Parcel #5749 and 5143, located at 2501 Corinth Road, for a revision to the existing conditional use permit to add 6.5 additional acres from an adjoining tract to the existing campground site, add a spray water park, and 98 additional RV camp sites ( Link)

22. Public Hearing for Conditional Use Permit: Public hearing to receive public comments on a request by Michael Gress, Parcel #80117, located at 56 Weaver Trail, on one (1) acre out of a 5.490 acre tract, for a conditional use permit specifically for a contractor’s storage facility ( Link)

23. Public Hearing on Redistricting: Public hearing to receive public comments on redistricting. With census data available from 2010, the Board of Commissioners is considering election district (County Commissioner Districts) boundary adjustments to account for population changes based in the census and will vote on same. Three options have been developed for public consideration and feedback are attached. ( Option 1, Option 2, and Option 3)

24. Human Relations Commission Presentation: Presentation by the Human Relations Commission

MANAGER’ S REPORTS

25. Manager’s Reports: The County Manager shall report on miscellaneous County business at this time.

COMMISSIONERS’ REPORTS

26. Commissioners’ Reports: Any Commissioner wishing to report on any County business may do so at this time.

Work Session

2. July 2011 Employees of the Month

3. Board of Education Presentation: Board of Education officials now have a firm number from the state concerning the gap that must be bridged to minimize the possibility of further Education financial issues. The Board of Education has $706,181.00 funding gap to fill.

4. Guardians of Angels Presentation: Rev. Terry Dorsey will be making an introduction to the Board of Commissioners about his plan to create a better facility for adoption of pets ( Proposal)

5. Chatham Transit Service Changes and Overviews: Presentation by Amber Wagner

6. Chatham County Bicycle Plan: Melissa Gilbeau will present an update on Chatham County Bicycle Plan and has asked the Board of Commissioners to consider adoption of plan ( Chatham County Bicycle Plan Final Draft)

7. Transportation Advisory Committee Presentation: Brief presentation by the advisory committee on their work, mission and goals.

8. Green Building and Sustainable Energy (GBASE) Annual Report ( Link)

9. County Broadband Audit Report: This is a summary report of a study of internet access in Chatham County presented by Action Audits.

10. Soil & Water Conservation District Board: Presentation and feedback on one-cent per 100 gallons for water quality protection. At their June 16, 2011meeting, the Board of Commissioners began exploring the idea of implementing a one-cent per one hundred gallon surcharge (writers term) on water consumed by customers using the Chatham County utility system water. Staff estimates that this would generate about $70,000 annually for such activities. During that discussion, the Board also asked staff to explore projects that might fit water protection guidelines. Representatives from the Solid and Water Conservation District will be present to talk about their ideas.
